Art. 10(1)2 of the Luxemburgian Act on Copyright, Neighboring Rights and Databases, as amended by the Act of April 18, 2004, states that the author may not prohibit:
“the reproduction and the communication to the public of short fragments of works for the sole purpose of illustration for teaching or scientific research, to the extent justified by the non commercial purpose to be achieved, and provided that such use complies with good usages and that, unless this turns out to be impossible, the source, including the author’s name, is indicated.”
